General Terms and Conditions (GTC) – Landhäuser BergWiese

  1. Scope
    These GTC apply to all contracts concluded with the accommodation provider from December 2022 onwards for the rental provision of accommodation as well as all related services.
    Any differing terms and conditions of the guest shall apply only if this has been agreed in writing in advance.
  2. Withdrawal by the guest (cancellation)
    Withdrawal from the contract is possible at any time, but must be made in writing.

    In the event of cancellation due to force majeure (e.g. natural disasters) or as a result of official orders (e.g. pandemics), the guest will not incur any cancellation fees. Any deposits already paid will be refunded in full.

    In all other cases, the following scale applies:

  • Cancellation up to 61 days before the start of the rental period: Deposit will be retained
  • Cancellation 60–15 days before the start of the rental period: 50% of the total price
  • Cancellation 14–8 days before the start of the rental period: 80% of the total price
  • Cancellation less than 8 days before the start of the rental period: 100% of the total price

    The date of receipt of the cancellation notice shall apply. Payments already made will be offset accordingly.

    The guest may nominate a replacement person who enters into the contract under the same conditions. Written confirmation from the guest and the replacement person is required.

  1. Conclusion of contract and payment terms
    The contract is deemed concluded upon receipt of the booking confirmation from the accommodation provider. A deposit of 20% of the rental price must be paid within 7 days of the booking confirmation. The remaining balance is due no later than 10 days before arrival. In each case, the date of receipt of payment shall apply.

    Vouchers (e.g. when booking via the website) are valid for 12 months from the date of booking, are non-transferable and can be redeemed once only. Further conditions will be communicated upon issue.

    Utilities are included in the rental price.

    A visitor’s tax must be paid directly to the responsible municipality.

    Payments by credit card, cheque, etc. are accepted only on account of performance.

    The accommodation provider may withdraw from the contract if:

  • agreed advance payments are not made on time,
  • force majeure makes performance of the contract impossible,
  • use endangers the safety or reputation of the establishment,
  • the accommodation is used by more persons than booked.

    The withdrawal will be communicated to the guest in writing within 7 days of becoming aware of the reason for withdrawal.

    Set-off by the guest is permitted only with undisputed claims or claims that have been finally adjudicated.

  1. Arrival and departure
    The accommodation can be occupied from 3:00 PM on the day of arrival. On the day of departure, the accommodation must be vacated by 10:00 AM at the latest. If exceeded by more than 30 minutes, an additional booking day may be charged.

    Other times may be agreed in advance (e.g. key safe).

    If the guest does not arrive by 10:00 PM on the day of arrival, the contract shall be deemed terminated. The landlord may dispose of the accommodation freely.

  1. Use, obligations and liability of the guest
    The accommodation may be used only as intended and only by the persons booked. Any transfer or subletting requires written consent.

    Defects must be reported immediately. The guest is liable for all damage caused by them, their fellow travellers or authorised third parties, unless the guest is not at fault.

    If justified, a security deposit of up to five nightly rates may be charged. This must be paid no later than 10 days before arrival. A handover and return report will be prepared. The deposit will be refunded in full provided no damage is found.

  1. Safety, Wi-Fi, non-smoking policy, pets, special use

    Quiet hours:
    Statutory night-time quiet hours apply from 11:00 PM. Please avoid all loud activities inside and outside the accommodation from this time onwards. Consideration for other guests is expressly requested.

    Slope protection:
    The slope protection on the property at Braunlager Straße 11 is not suitable for walking on – especially not for children. Supervision is the responsibility of the legal guardians.

    Wi-Fi:
    Wi-Fi is available free of charge; availability is not guaranteed. Access data is personal and must not be shared. Use is at your own risk. The guest is liable for any abusive or unlawful use and indemnifies the accommodation provider against third-party claims.

    Smoking:
    Smoking is not permitted in the accommodation. Please use balconies, terraces or outdoor areas.

    Pets:
    Are permitted in all of our properties.

    Parking:
    One signposted parking space is available per unit. Additional free parking spaces are located at the Kurhaus. The provisions of the German Road Traffic Regulations (StVO) apply. No liability for damage unless caused intentionally or by gross negligence.

    Equipment shed:
    For storing sports equipment. Use at your own responsibility. No liability for theft or damage.

    BBQ hut:
    For shared use. After use, the fire pit must be cleaned and glowing embers extinguished. No liability for damage unless caused intentionally or by gross negligence.

    Sauna:
    Free use daily from 4:00 PM to 9:00 PM. Water for infusions must be brought by the guest. Please also bring any aromatic additives yourself. Cooling down takes place outdoors or in your own accommodation.

  1. Data protection
    The tenant agrees to the storage and processing of personal data for the purpose of fulfilling the contract and issuing the visitor’s card.
  2. Liability and force majeure
    The accommodation provider is not liable for impairments caused by force majeure (e.g. power outage, severe weather, construction sites) or official orders. Arrival and departure as well as personal belongings are the guest’s own responsibility and liability.
  3. Place of performance and jurisdiction
    The place of performance is St. Andreasberg. The place of jurisdiction is Clausthal-Zellerfeld. German law applies.
  4. Final provisions
    Amendments and additions to the contract must be made in writing. This also applies to any waiver of the requirement for written form.

    Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that is economically and substantively equivalent. The statutory provisions shall apply in addition.
